Protecting forests
Protecting Climate Positive's forest restoration projects is an important and complex process which involves preserving and protecting land and vegetation for generations to come. Climate Positive uses a two-pronged approach to forest protection.
Forest Property Agreement
- Covers the right to establish and maintain the forest
- Protects the forest and the ownership of the carbon
- Restricts use of the land covered by the agreement
- Requires CP to plant biologically diverse forest
- 100 years
- Registered on title
- Binds successors in title.
- Includes obligation to seek to obtain Trust for Nature Covenant over the forest.
Trust for Nature Covenant
What is a Conservation Covenant?
A conservation covenant is an agreement between a landowner and Trust for Nature, which protects and enhances the natural, cultural and/or scientific values of the land. The covenant is registered on the property title and binds all future owners. Conservation covenants derive from the Victorian Conservation Trust Act 1972. They have the force of statute, and should be distinguished from common law covenants.
How does a conservation covenant protect my land?
A conservation covenant permanently protects the conservation values of your land beyond your lifetime by registering a voluntary agreement between yourself and the Trust for Nature on the Title to your property. This enables you to ensure that future owners respect the conservation values that you have worked so hard to protect.
The covenant runs con-currently with the Forest Property Agreement, but continues after the expiration of the Forest Property Agreement.
